{"id":1221,"date":"2023-11-13T12:37:22","date_gmt":"2023-11-13T11:37:22","guid":{"rendered":"https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/?p=1221"},"modified":"2023-11-13T13:58:59","modified_gmt":"2023-11-13T12:58:59","slug":"manuel-martinez-sospedra-tamano-del-congreso-el-debate","status":"publish","type":"post","link":"https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/manuel-martinez-sospedra-tamano-del-congreso-el-debate\/","title":{"rendered":"\u00abSobre el tama\u00f1o del Congreso\u00bb por Manuel Mart\u00ednez Sospedra en \u00abEl Debate\u00bb"},"content":{"rendered":"\n<p><strong><em>El pasado mes de octubre, el Catedr\u00e1tico Em\u00e9rito de la Universidad CEU Cardenal Herrera, Manuel Mart\u00ednez Sospedra public\u00f3 una columna de opini\u00f3n en el medio \u00abEl Debate\u00bb, donde evaluaba la posibilidad de aumentar el tama\u00f1o del Congreso de los Diputados<\/em><\/strong><\/p>\n\n\n\n<p>El <strong>Catedr\u00e1tico Em\u00e9rito de Derecho Constitucional Manuel Mart\u00ednez Sospedra<\/strong>, miembro del equipo investigador, ha publicado una columna en el medio digital <strong>El Debate<\/strong> sobre la discusi\u00f3n alrededor de la reforma del sistema electoral y el n\u00famero de esca\u00f1os en el Congreso de los Diputados.<\/p>\n\n\n\n<p>En primer lugar, el profesor Mart\u00ednez Sospedra hace un<strong> breve repaso hist\u00f3rico<\/strong> sobre el tama\u00f1o del Congreso de los Diputados. Resalta que, seg\u00fan la <strong>Ley Electoral de 1846<\/strong>, cuando Espa\u00f1a ten\u00eda una poblaci\u00f3n de alrededor de 10 millones de personas, el Congreso ya alcanzaba su tama\u00f1o actual de 350 diputados. La particularidad que se\u00f1ala es que, en aquel momento, la Ley Electoral estipulaba que el criterio seguido para definir el tama\u00f1o del congreso era de tener <strong> <\/strong>Durante el resto del s. XIX y el comienzo del s. XX hasta la Segunda Rep\u00fablica,<strong> el Congreso alcanz\u00f3 su mayor tama\u00f1o, con 473 diputados en 1933<\/strong>.<\/p>\n\n\n\n<p>A diferencia de lo sucedido antes de la Guerra Civil, <strong>las reglas constitucionales de 1977 no permiten los ajustes establecidos anteriormente en funci\u00f3n a una ratio entre poblaci\u00f3n y esca\u00f1os<\/strong>, congelando el tama\u00f1o de la c\u00e1mara entre 300 y 400 diputados. A continuaci\u00f3n, el profesor Mart\u00ednez Sospedra nos muestra c\u00f3mo se ver\u00eda el Congreso<strong> si se hubiera mantenido la ratio original de 1977 habitantes: en 2023 el Congreso tendr\u00eda 469 esca\u00f1os<\/strong>, y si se toma en cuenta el envejecimiento poblacional y el consiguiente crecimiento del censo, llegar\u00eda a 551 diputados. Estos tama\u00f1os estar\u00edan <strong>m\u00e1s cerca de los parlamentos de Polonia y Francia <\/strong>respectivamente.<\/p>\n\n\n\n<p>Finalmente, el profesor Mart\u00ednez Sospedra se\u00f1ala que <strong>considerando la alta demanda registrada por el CIS para la reforma del sistema electoral y la mejora de la proporcionalidad<\/strong>, expandir el tama\u00f1o del Congreso abrir\u00eda tambi\u00e9n posibilidad de ir hacia un sistema electoral m\u00e1s proporcional similar al sistema alem\u00e1n, que combina la representaci\u00f3n proporcional y la uninominal.<\/p>\n\n\n\n<p>Lee el
