Being the focus of attention of the <strong>European Union <\/strong>and facing several <strong>infringement proceedings<\/strong> brought by the <strong>European Commission<\/strong> before the <strong>Court of Justice of the EU<\/strong>, it has been, together with <strong>Poland<\/strong>, one of the countries to be subject to the <strong>conditionality mechanism<\/strong> that allows<strong> restricting the granting of European funds to protect the Union&#8217;s budget from the consequences of the violation of the principles of the rule of law.<\/strong><\/p>\n\n\n\n<p>One of the main <strong>challenges<\/strong> facing the country is the protection of<strong> freedom of expression and media pluralism,<\/strong> resulting from the adoption of restrictive measures such as the so-called <a href=\"https:\/\/www.mil21.es\/noticia\/6426\/claves\/la-union-europea-amenaza-a-hungria-por-prohibir-la-propaganda-a-favor-de-la-pedofilia-en-las-escuelas.html\">&#8220;child protection law&#8221;<\/a>; which limited access to written material on LGBT+ issues, to the use of intelligence networks and pro-government media.<\/p>\n\n\n\n<p>In this regard, the <a href=\"https:\/\/democracyinstitute.ceu.edu\/projects\/rule-law-clinic\">Rule of Law Clinic (RoL Clinic<\/a>) of the<a href=\"https:\/\/democracyinstitute.ceu.edu\/\"> Institute of Democracy <\/a>of the <a href=\"https:\/\/democracyinstitute.ceu.edu\/\">Central European University (CEU) in Budapest<\/a>, of which <strong>Barbara Grabowska<\/strong> is the Director, organized in collaboration with relevant institutions such as <a href=\"https:\/\/transparency.hu\/en\/\">Transparency International Hungary <\/a>and the<a href=\"https:\/\/www.americanbar.org\/groups\/human_rights\/justice_defenders\/\"> Justice Defenders Program<\/a> of the <a href=\"https:\/\/www.americanbar.org\/groups\/human_rights\/justice_defenders\/\">Center for Human Rights of the American Bar Associat<\/a>ion, a seminar with the participation of experts in the field to reflect on the challenges for freedom of expression in Hungary.<\/p>\n\n\n\n<p>The event reflected on the<strong> most recent challenge<\/strong> in the Hungarian free speech and media landscape, namely the adoption of a &#8220;protection of national sovereignty&#8221; law that gives the government <strong>unlimited discretion<\/strong> to investigate <strong>civil society organizations<\/strong> and others that the Hungarian government deems to be engaged in political activities <strong>&#8220;influencing democratic debate and the decision-making process&#8221;<\/strong>.<\/p>\n\n\n\n<p>The seminar included the participation of David Kaye, former United Nations Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression and current Professor of International Law at the University of California at Irvine, who emphasized the <strong>strength and importance<\/strong> of these rights as well as <strong>popular sovereignty <\/strong>in their protection.<\/p>\n\n\n\n<p>Focusing on the<strong> consequences<\/strong> of the <strong>European Parliament elections<\/strong> and the <strong>Hungarian local elections<\/strong> of June 9 for the functioning of the free media, as well as the <strong>effects<\/strong> of the <strong>&#8220;protection of popular sovereignty&#8221;<\/strong> law on civil society, <strong>David Kaye celebrated the Hungarian resistance and the important role played by Hungarian organizations and individuals committed to the defense of fundamental rights.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"http:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog.jpeg\" alt=\"\" class=\"wp-image-2057\" srcset=\"https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog.jpeg 1024w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-300x225.jpeg 300w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-768x576.jpeg 768w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-150x113.jpeg 150w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-696x522.jpeg 696w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-560x420.jpeg 560w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-80x60.jpeg 80w, https:\/\/blog.uchceu.es\/rule-of-law-crisis-eu\/wp-content\/uploads\/sites\/45\/2024\/07\/foto-blog-265x198.jpeg 265w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Credits of the picture belong to CEU Democracy Institue and to the Justice Defenders Program of the American Bar Association.<\/figcaption><\/figure>\n\n\n\n<p>Professor Kaye&#8217;s speech was followed by a panel discussion moderated by <strong>Benjamin Novak<\/strong>, former reporter at <strong>The New York Times<\/strong>, in which several academic experts, including<strong> Fernanda Nicola, Miklos Ligeti, Andras Kaglar, Bea Bodrogi, Dimitry Kochenov and Barbara Grabowska<\/strong>, reflected on the threats to freedom of expression in Hungary.<\/p>\n\n\n\n<p>In particular,<strong> Barbara Grabowska<\/strong> reflected on the question of<strong> whether values are just a nice part of the EU Treaties or whether they are law, in which case, they must be enforced.<\/strong> In this task, she said, <strong>&#8220;time is a crucial factor&#8221;<\/strong>.
