\u201cYour honor, ladies and gentlemen\u2026\u201d \u2013 the \u2018Sal\u00f3n de Grados\u2019 in the library of\u00a0University CEU Cardenal Herrera<\/a>\u00a0is converted into an authentic courtroom, two parties are facing each other under the eyes of their judge: lawyer and professor,\u00a0Daniel Herranz. Six of his students of the second year\u2019s course of the \u201cSpecialist Degree in International and European Law<\/strong>\u201d have formed two teams of three participants:\u00a0Noelia Puchol Sancho<\/strong>,\u00a0Mineya Pellicer Vidal<\/strong>\u00a0y\u00a0Irene Vidal Miralles<\/strong>\u00a0as the defending party and\u00a0Estela Olivares<\/strong>,\u00a0Zitan Peng Hao<\/strong>\u00a0and\u00a0Borja Comes Mart\u00ed<\/strong>\u00a0as the complaining party.<\/p>\n

Students during the Moot Trial<\/figcaption><\/figure>\n

The students had prepared for this simulated trial scenario for several months \u2013 as it was their final exam of the subject of Legal English<\/strong>, their main aim was to present the most convincing arguments, of course. The simulated lawsuit was on a case that could not have been more current and complex at the same time: the legality of web portals offering transport possibilities by sharing costs such as Bla Bla Car.<\/p>\n

\"Moot_Trial_Law_Valencia_CEU_UCH\"<\/p>\n

After the defending party, pretending to be the ridesharing community ‘Bla Bla Car’, and the complaining party, pretending to be a passenger transportation company, had introduced themselves, they presented their arguments or rejected the ones of the opposition. Taxes, consumer law and insurances were controversial issues the students were discussing about showing rhetorical skills and insider knowledge.<\/p>\n

\u201cOn the website of the company, Bla Bla Car, you can find the price of the car journey, its destination and the date of it \u2013 those are the three elements of travel service\u201d, argued the complaining party whereas the defending party opposed by saying that their company\u2019s intention is to \u201cput in contact drivers and passengers\u201d which, according to them, is \u201ccertainly not an element of travel service.\u201d Another controversial matter the law students debated about was the question about insurance, \u201cthe driver might not even have a driving license, how does the client know that he or she will arrive safely?\u201d. \u201cThe client can easily contact the driver, so he or she can ask the driver about it\u201d, answered the defending party.<\/p>\n

\"Students_Law_CEU_UCH\"<\/p>\n

After a vibrant and dynamic lawsuit with a final conclusion of the parties\u2019 positions, the ‘judge’, Daniel Herranz, declared the case closed, congratulating the students on their good performance afterwards. Although activities like this stimulated lawsuit are rather rare, the professor and lawyer considers them an important possibility to gain practical experience: \u201cMoot trials<\/strong> are habitual activities in many European and North American universities. They help students get to know the legislation by means of practical exercises and gain experience in presenting their arguments in a convincing way \u2013 and in legal English<\/strong>.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
